Hey Famm LLC, a California limited liability and its affiliates (collectively, “Famm,” “us,” “our,” and “we”) is committed to protecting your privacy and personal information. This Privacy Policy describes our privacy practices and how we handle information that we collect and use when you access our products, services, features, or content through, without limitation, our website, applications, business offerings, application programming interfaces (“APIs”), communications between you and us, software provided on or in connection with those products, services, features, or content (collectively, the “Services”). This Privacy Policy does not apply to information we collect offline or through any other means, including on any other website operated by Famm, or any third party, including through any application or content that may link to or be accessible from or through this website. As used herein, the term “you” (including any variant) refers to each individual who enters into this Privacy Policy on such individual’s own behalf or any entity on behalf of which an individual enters into this Privacy Policy, in which case you represent and warrant that you have the authority to bind that entity to this Privacy Policy (and in that case, “you” will refer to the individual and that entity).

We reserve the right to modify this Privacy Policy at any time. If we make material changes to this Privacy Policy, we will notify you by updating the date of this Privacy Policy and posting it on the Services. If required by law we will also provide notification of changes in another way that we believe is reasonably likely to reach you, such as via email or another manner through the Services. Any modifications to this Privacy Policy will be effective upon our posting the modified version (or as otherwise indicated at the time of posting). In all cases, your use of the Services or your giving us personal information after the effective date of any modified Privacy Policy indicates your consent to and acceptance of the modified Privacy Policy.

The Services are not directed to or intended for use by individuals under eighteen (18) years of age, even including those persons eighteen (18) years of age who have consent from their parent or guardian to use our Services. No one under the age of eighteen (18) may provide any personal information.  We do not knowingly collect personal information from individuals under the age of eighteen (18). If we learn that we have collected personal information through the Services from an individual under eighteen (18) years of age without the consent of the individual’s parent or guardian as required by law, we will delete it. Your Privacy Bill of Rights

Famm is committed to and steadfast about trust, respect, and integrity when it comes to your privacy and personal data by following these core principles:

  • We never sell your personal data.

  • You own your personal data and content. It belongs to you, not us.

  • You will not be targeted with ads from outside brands or advertisers. Ads on Hey Famm come exclusively from fellow members promoting their own work, projects, or businesses, never from external companies or agencies.

  • You control the customization of your information and your feeds.

  • We do not manipulate your feeds.

  • You have the right to control your privacy permissions. 

  • You can opt out of letting others access your content and keep your profile private if you wish.

  • You can delete your account anytime and take your content with you whenever you leave. Please note that account deletion is permanent and cannot be undone.

  • Your privacy is our priority – no compromises.

  • Ads in your feed are always clearly labeled. We handle FTC-required ad disclosure automatically — you'll always know when you're looking at a paid post.

Personal information we may collect and how we may collect it

We collect information that you provide to us and depending on how you interact with the Services. You may provide us with information that alone or in combination with other information in our possession may be used to identify you through the Services or otherwise; such information (with examples) includes, but is not limited to:

  • Contact Data: such as your first and last name, salutation, email address, billing and mailing addresses, and phone number.

  • Profile Data: such as the username and password that you may set to establish an online account with us, photograph, biographical information, and any other information that you add to or is associated with your account.

  • Personal Identification Information

  • Communications Data: such as communications that we exchange with you, including when you contact us with questions or feedback, through the Services, social media, or otherwise.

  • Inferences: such as any inferences drawn from or created based on any of the information identified in this section, including User Content.

  • Payment and Transactional Data: such as information relating to or needed to complete your orders and/or payments on or through the Services (including payment card information and billing information) and your purchase history.

  • Marketing Data: such as your preferences for receiving our marketing communications and details about your engagement with them.

  • User-Generated Content: such as photos, images, music, videos, comments, questions, messages, correspondence, and other content or information that you generate, transmit, or otherwise make available on the Services to us or other persons, as well as associated metadata.

  • Technical Usage Data: such as interactions with and use of the Services within the product application, including time zone, IP address, dates of access, and similar information collected through application-level analytics and security technologies.

  • Device Data: such as the operating system, browser, name of the device you are using to access the Services.

  • Advertiser Data: if you purchase an Ad Placement, we collect your ad creative (images, copy, links), the details of your booking, and information needed to verify your eligibility as an active Hey Famm member. This information is used to review, approve, and run your ad, and to process your payment.

Third-Party Sources. We may combine personal information we receive from you with personal information we obtain from other sources, such as:

  • Marketing Partners: such as joint marketing partners, influencers, organizations, and event co-sponsors in connection with direct collaborations or events, not for behavioral advertising or cross-site tracking.

Automatic Data Collection. Within the product application, we, our service providers, and business partners may automatically log information about your device and interactions with the Services for security, functionality, and product improvement purposes.”

  • Device Data: such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, random access memory (RAM) and disk size, central processing unit (CPU) usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., Wi-Fi, LTE, 3G), and general location information such as city, state or geographic area.

  • Performance Data: such as clickstream data and diagnostic, crash, website, performance logs and reports.

  • Online Activity Data: such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to the Services, navigation paths between pages or screens, information about your activity on a page or screen, access times and duration of access, and whether you have opened our marketing emails or clicked links within them.

  • Location Data: such as your location when you authorize the Services to access your device’s location.

Cookies, Tracking, and Similar Technologies

Marketing Website

Our publicly accessible marketing website uses essential cookies only, where applicable, to enable basic functionality, security, and page navigation. We do not use analytics, advertising, session replay, or cross-site tracking technologies on our marketing website.

Because only essential technologies are used, no prior consent is required for the operation of the marketing website under applicable data protection and cookie laws, including the EU General Data Protection Regulation (“GDPR”) and Germany’s Telecommunications and Telemedia Data Protection Act (TTDSG).

Product Application (Authenticated Users)

We use limited analytics and similar technologies within our product application only, and only after you have created an account and logged in. These technologies are used solely to:

  • Ensure the Services function properly

  • Maintain security and prevent fraud or abuse

  • Understand how core features are used in order to improve reliability and performance

We do not track users across websites or services, do not use tracking technologies for advertising, and do not sell personal data.

Any analytics used within the product follow data-minimization principles, including limited retention, restricted access, and, where applicable, IP address anonymization.

Users may exercise their rights to object to or limit certain processing activities as described in this Privacy Policy.

Data About Others

Users of the Services may have the opportunity to refer contacts to us and share their contact information. Please do not refer someone to us or share their contact information unless you have their permission to do so.


How we may use, and the purpose of processing, your personal information

We may use your personal information for the following purposes or as otherwise described at the time of collection:

  • provide, operate, conduct research on and improve the Services and our business;

  • process your payments and complete transactions with you;

  • conduct Know Your Customer (KYC) checks, background checks and other screens permitted by law;

  • establish and maintain your user profile on the Services;

  • facilitate your invitations to associates who you may want to invite to use the Services;

  • enable peer-to-peer communication;

  • assess your eligibility for the Services;

  • enable security features of the Services, such as by sending you security codes via email or SMS, and remembering devices from which you have previously logged in;

  • prevent, identify, investigate and deter fraud, misuse of the Services, or harmful, unauthorized, unethical or illegal activity, criminal activity;

  • communicate with you about the Services, including by sending announcements, updates, security alerts, and support and administrative messages;

  • fulfill and comply with applicable law or our good faith belief that action is necessary to fulfill and comply with applicable laws, lawful requests, and legal obligations and processes to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other third parties, including without limitation auditing our internal processes for compliance with legal and contractual requirements or our internal policies and enforcing the terms and conditions that govern the Services;

  • protect our, your or others’ rights, privacy, safety or property (including by making and defending legal claims);

  • understand your needs and interests, and personalize your experience with the Services and our communications; and

  • provide support for the Services, and respond to your requests, questions and feedback.

  • Advertising review and delivery. If you purchase an Ad Placement, we use the information and content you submit to review your ad for compliance with our Ad Guidelines, deliver the ad to the feed, and process your payment. Ad content you submit is stored for the duration of your booking and for a reasonable period afterward for record-keeping purposes.

Aggregated or De-Identified Information for Research and Development. We may use your personal information for research and development purposes, including to analyze and improve the Services and our business. As part of these activities, we may create aggregated, de-identified or otherwise anonymized data by removing information that makes the data personally identifiable to you (collectively, “Aggregated Data”) from personal information we collect and we will not attempt to re-identify such Aggregated Data. We may use this Aggregated Data, publish such Aggregated Data, make such Aggregated Data generally available, or share such Aggregated Data with third parties for our lawful business purposes, including without limitation to analyze and improve the Services and promote our business. 

With your Consent. In some cases, we may specifically ask for your consent to collect, use or share your personal information, such as when required by law.


How we share your information

We may share your information with the following parties and as otherwise described in this Privacy Policy or at the time of collection without further notice to you, unless required by law:

  • Affiliates: Famm entities such as any subsidiaries for purposes and in a manner consistent with this Privacy Policy.

  • Service Providers and Vendors: third parties that provide services on our behalf or help us operate the Services or our business (such as hosting, information technology, customer support, email delivery, marketing, and website analytics).

  • Payment Processors: any payment information you use to make a purchase (including payment card information and billing information) on the Services is collected and processed directly by our payment processors, which may use your payment information in accordance with their respective privacy policies.

  • Third-Party Platforms: if you have enabled features or functionality that connect the Services to a third-party platform or social media network (such as by linking your account with the Services to a third party’s services), we may disclose the personal information that you authorized us to share. We do not control the third party’s use of your personal information.

  • Professional Advisors: professional advisors, such as lawyers, auditors, bankers, and insurers, when necessary in the course of the professional services that they render to us.

  • Authorities and Others: your personal information may be shared with law enforcement or other third parties when required to comply with applicable laws, regulations, legal processes, or enforceable government requests. For the avoidance of doubt, we take the privacy of your personal information seriously and are committed to protecting it. We will only disclose your information to law enforcement, regulatory authorities, or other third parties when legally compelled to do so, such as in response to a valid subpoena, court order, or other enforceable legal process. All such requests are carefully reviewed to confirm they are lawful, specific, and justified. We do not voluntarily share personal information with government entities or third parties without a clear and binding legal requirement. Any disclosure that must occur will be as limited as possible and strictly confined to what the law requires. In rare cases, we may also disclose information if it is absolutely necessary to detect or prevent fraud, respond to security threats, resolve technical issues, or protect the rights, property, or safety of Famm, our users, or the public – as permitted or required by law.

  • Business Transferees: potential and actual acquirers and other relevant participants in business transactions (or negotiations and diligence for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, bankruptcy, receivership, sale or other disposition or transfer of all or any portion of the business or assets of, or equity interests in, Famm or our affiliates when in the course of the diligence process with counterparties and other parties assisting such transactions and when transferred to a successor or affiliate as part of such transactions along with other assets.

  • Other Users and the Public: your personal information may be visible to other users of the Services and the public. In situations in which your personal information can be seen, collected and used by others, including being cached, copied, screen captured or stored elsewhere by others (e.g., search engines), we are not responsible for any such use of information.

Your choices and rights

You have the following choices with respect to your personal information and, depending on location, you may have certain statutory rights to:

  • Access, Delete, Transfer or Update Your Information: If you have registered for an account with us through the Services, you may access, delete, transfer or update certain account information by logging into the account.

  • Opt-Out of Marketing Communications: you may opt-out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, as applicable, or by contacting us at: support@heyfamm.com. Please note that if you choose to opt-out of marketing-related communications, you may continue to receive service-related and other non-marketing communication.

  • Cookie Restrictions: In the context of our product application, you may manage or restrict cookies and similar technologies through your browser or device settings.

    most browser settings let you delete and reject cookies placed by websites. Many browsers accept cookies by default until you change your settings. If you do not accept cookies, you may not be able to use all functionality of the Service and it may not work properly. For more information about cookies, including how to see what cookies have been set on your browser and how to manage and delete them, visit www.allaboutcookies.org.  You may be able to limit use of HTML5 cookies in your browser settings. Unlike other cookies, Flash-based local storage cannot be removed or rejected via your browser settings, but you can adjust the settings of your Flash player to block it.   • Declining to Provide Information: We may need to collect personal information to provide certain services. If you do not provide the information we identify as required or mandatory, we may not be able to provide those services.

  • Third-Party Platforms: If you choose to connect to the Service through a third-party platform, you may be able to use your settings in your account with that platform to limit the information we receive from it. If you revoke our ability to access information from a third-party platform, that choice will not apply to information that we have already received from that third party.

  • Advertising choices: Although we do not engage in third-party interest-based advertising, if you are concerned you may limit such advertising via:

  • Browser settings. Blocking third-party cookies in your browser settings.

  • Privacy browsers/plug-ins. By using privacy browsers or ad-blocking browser plug-ins that let you block tracking technologies.

  • Platform settings. Google and Facebook offer opt-out features that let you opt-out of use of your information for interest-based advertising:

Although Famm does not engage in third-party interest-based advertising, the following information is provided for general reference.

Other sites and services

The Service may contain links to third-party operated services and business offerings such as websites, mobile applications, and other online services. In addition, our content may be integrated into web pages or other online services that are not associated with or controlled by us. The information you share with such third-party services are governed by policies and practices of the third-parties and not governed by this Privacy Policy. These links and integrations are not an endorsement by us of or representation that we are affiliated with or have reviewed any third party. We do not control websites, mobile applications or online services operated by third parties, and we are not responsible for their actions. We encourage you to read the privacy policies and practices of the other websites and mobile applications and online services you use, and  please contact such third parties directly for additional information on their privacy policies and practices.

Security

We implement many commercially reasonable, technical, administrative organizational and physical safeguards designed to protect the personal information we collect both online and offline from loss, misuse, and unauthorized access, disclosure, alteration, or description. However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.  Therefore, you should take special care in deciding what information you send to us or any third-parties. In addition, we are not responsible for circumvention of any privacy settings or security measures contained on the Service or third party services and business offerings.

Retention

We will retain your personal information for only as long as we need to provide our Services to you, or for other legitimate business purposes such as resolving disputes, safety and security reasons, or complying with our policies and legal obligations. How long we retain personal information will depend on a number of factors, such as the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, our purpose for processing the information, and any legal requirements. We may also create and use Aggregated Data for research, statistical or other lawful, as described above, in which case we may use this information indefinitely without further notice to you.

You may request deletion of your personal data at any time by contacting us at support@heyfamm.com, subject to any legal obligations we may have to retain certain information.

Prevention of Harmful Conduct and Hate Speech

Famm is committed to fostering a safe, inclusive, and respectful environment for all users. As part of this commitment, we strictly prohibit the use of the Services for the promotion, incitement, or facilitation of racism or racial superiority of any kind, bigotry, hatred, homophobia, transphobia, white supremacy, white nationalism, neo-Nazism or physical harm against any group or individual. We therefore reserve the right to investigate and take appropriate action - including the removal of content, suspension of accounts, and referral to legal authorities - if we believe our platform is being used in violation of these principles.

Your Privacy Rights

If you are a resident of the United States, you may have additional rights under the laws of your state in which you reside.

For example, if you are a California resident, you may have certain rights under the California Consumer Privacy Act (“CCPA”) with respect to information collected by us during the 12 months preceding your request to exercise such rights. These include the right to (i) request access to, details regarding, and a copy of the personal information we have collected about you and/or shared with third parties; (ii) request deletion of the personal information that we have collected about you; and (iii) the right to opt-out of sale of your personal information. As the terms are defined under the CCPA, we do not “sell” your “personal information.”

California residents may also request the following information (to the extent we share your personal information in this way):

  • the categories of information we disclosed to third parties for the third parties' direct marketing purposes during the preceding calendar year; and

  • the names and addresses of third parties that received such information, or if the nature of their business cannot be determined from the name, then examples of the products or services marketed.

To exercise your privacy rights as a resident of California or another state please contact us at support@heyfamm.com. In your request, you must provide your first and last name, your mailing address, and certify that you are a resident of California or the state under which you are exercising your privacy rights. We reserve the right to require additional information to confirm your identity and residency.  Please note that we will not accept requests via telephone, mail, or facsimile, and we are not responsible for notices that are not labeled or sent properly, or that do not have complete information.

Notwithstanding the above, we cannot edit or delete any information that is stored on a blockchain or other technologies involving immutable records.

International data transfer

We are headquartered in the United States and may use service providers that operate in other countries. Your personal information may be transferred to the United States or other locations where privacy laws may not be as protective as those in your state, province, or country. By using the Services, you consent to the transfer of your personal data to countries outside of your own, as outlined above.

Supplemental Information for the European Economic Area, Switzerland and the United Kingdom

These terms supplement our Privacy Policy regarding the processing of personal data from the European Economic Area (EEA), which includes the European Union Member States, Iceland, Liechtenstein, and Norway, as well as Switzerland and the United Kingdom (UK). In the event of any conflict between these terms and other sections of our Privacy Policy, this section will govern with respect to the processing of EEA, Swiss, and UK personal data, where applicable.

  • Data Controller: the entity responsible for processing your personal data under this Privacy Policy is the Famm entity with which you have a primary relationship, which may be the entity that has entered into a service contract with you, the entity that has provided you with marketing communications, the primary entity operating in the region where you access our services. In most cases, the data controller is Hey Famm LLC, unless otherwise specified

  • Legal Basis for Processing:  For individuals located in the European Economic Area (EEA), the United Kingdom, and Switzerland, we process personal data under one or more of the following legal bases pursuant to Article 6 of the GDPR:

    • Performance of a contract – to provide, operate, and maintain the Services you request, including essential analytics necessary to deliver and improve core functionality.

    • Legitimate interests – to secure our Services, prevent fraud and abuse, ensure platform integrity, and improve product performance, provided such interests are not overridden by your fundamental rights and freedoms.

    • Legal obligations – to comply with applicable laws, regulations, lawful requests, and legal processes.

    • Consent – where required by law, such as for optional features or processing activities not strictly necessary for the operation of the Services.

    You may withdraw your consent at any time and may object to processing based on legitimate interests as described in the “Your Rights and Choices” section of this Privacy Policy.

  • Data Protection Rights: Under applicable data protection laws, you may exercise certain rights regarding your personal data as outlined below. To exercise any of the following rights, please contact us using the contact details in this Privacy Policy. However, requests may be denied in certain cases, such as when they infringe on another individual’s privacy rights or conflict with legal obligations.

    • Right to Access: you may request confirmation of whether we process your personal data and obtain a copy of your personal data undergoing processing.

    • Right to Data Portability: if processing is based on your consent or a contract and is carried out by automated means, you may request to receive your personal data in a structured, commonly used, and machine-readable format for transfer to another data controller.

    • Right to Withdraw Consent: if you have provided consent for data processing, you may withdraw it at any time without affecting prior lawful processing.

    • Right to Rectification: you may request correction of inaccurate or incomplete personal data.

    • Right to Object: you may object to the processing of your personal data in certain circumstances. Right to Restrict Processing: you may request restrictions on the processing of your personal data in specific situations.

    • Right to Erasure: you may request the deletion of your personal data under certain conditions.

    • Right to Lodge a Complaint: you have the right to file a complaint with a supervisory authority, such as the EU Data Protection Authorities (DPAs), the U.K. Information Commissioner’s Office (ICO), the Gibraltar Regulatory Authority (GRA), or the Swiss Federal Data Protection and Information Commissioner (FDPIC).

    • Right to Avoid Automated Decision-Making: we do not engage in automated decision-making under Article 22(1) and (4) of the EU/UK General Data Protection Regulation (GDPR). If this changes, we will inform you and provide mechanisms for human intervention, expression of viewpoint, and contesting decisions.

    • In addition to the rights described above, users in Germany, Italy, and other EU member states have the right to:

      • Object to processing based on legitimate interests

      • Request restriction of processing in certain circumstances

      • Lodge a complaint with their local supervisory authority

As a result of our multinational reach, some data recipients may be located in countries outside the EEA, Switzerland, or the U.K., where data protection laws may not provide the same level of protection. When we transfer data internationally, we will comply with legal requirements by utilizing approved codes of conduct or certification mechanisms, EU Standard Contractual Clauses and/or the U.K. Addendum, approved binding corporate rules and/or permissible statutory derogations or other legally valid transfer mechanisms.

Some jurisdictions have been deemed to provide adequate data protection by EEA, Swiss, and U.K. authorities, in which case no additional safeguards are required. Supplemental Information for Other Countries and Regions

  • Australia: personal data collected, stored, used, and processed by Famm is handled in accordance with the Australian Privacy Act 1988 (Commonwealth) and the Australian Privacy Principles (APPs). If you are dissatisfied with our response to a complaint or disagree with our proposed resolution, you may escalate your concern to the Office of the Australian Information Commissioner (OAIC) via the contact methods listed on their website. Alternatively, you may request that we forward the details of your complaint to the OAIC on your behalf.

  • Brazil: personal data collected, stored, used, and processed by Famm complies with Lei Geral de Proteção de Dados (LGPD). By using or accessing our Services, you explicitly consent to the collection, use, storage, and processing of your personal data for the purposes described in this Privacy Policy.

  • Canada: personal data, as defined under the Personal Information Protection and Electronic Documents Act (PIPEDA), is collected, stored, used, and processed by Famm in compliance with its obligations under PIPEDA.

  • Japan: personal data collected, stored, used, and processed by Famm is managed in accordance with Japan’s Act on the Protection of Personal Information (APPI).

  • New Zealand: personal data collected, stored, used, and processed by Famm is handled in accordance with New Zealand’s Privacy Act 2020 and its 13 Information Privacy Principles (NZ IPPs).

  • Singapore: personal data collected, stored, used, and processed by Famm complies with the Personal Data Protection Act 2012 (PDPA) and Famm’s obligations under this law.
